दैनिक जागरण के कानपुर संस्करण के मुख्य पृष्ठ पर आज एक खबर प्रमुखता के प्रकाशित हुई, शीर्षक है, "'झूठे मुखबिर' बने 30 हजार दमाद"।
प्रश्न अब यह है कि जिस विषय में जानकारी न हो उस मुद्दे पर एकतरफा और भ्रमित करने वाला लेख प्रकाशित करने का क्या अभिप्राय है?
आंकडों के अनुसार आइ०पी०सी० की धारा 498a का 90% से ज्यादा दुरुपयोग है और लगभग 498a के हर झूठे मुक़दमे में शादी में किए गए खर्चे के बारे में खूब बढ़ा-चढ़ा कर आरोप लगाए जाते हैं। उद्देश्य, केवल समझौते का दबाव बनाकर ज्यादा से ज्यादा पैसे की उगाही करना।
इसी सब से क्रम में दिल्ली उच्च न्यायालय में न्यायाधीश शिव नारायण ढींगरा ने CRL.M.C.7262/2006, 'Smt Neera Singh vs The State (download judgment here) [Reported as 138 (2007) DLT 152; I (2007) DMC 545 ] में आदेश तारीखी 23/02/2007 में बिलकुल साफ-साफ कहा और पुलिस को दिशानिर्देश दिए कि:
"I consider where these kinds of allegations are made, the police should simultaneously register a case under Dowry Prohibition Act (in short, the Act) against the parents of the complainant as well, who married their daughter despite demand of dowry. Section 3 of the Act prohibits giving and taking of dowry" ... ... "Now-a-days, exorbitant claims are made about the amount spent on marriage and other ceremonies and on dowry and gifts. In some cases claim is made of spending crores of rupees on dowry without disclosing the source of income and how funds flowed. I consider time has come that courts should insist upon disclosing source of such funds and verification of income from tax returns and police should insist upon the compliance of the Rules under Dowry Prohibition Act and should not entertain any complaint, if the rules have not been complied with. Rule 2 of the Dowry Prohibition (Maintenance of List of Presents to the Bride and Bridegroom) Rules, 1985 reads as under:
2. RULES IN ACCORDANCE WITH WHICH LISTS OF PRESENTS ARE TO BE MAINTAINED.- (1) The list of presents which are given at the time of the marriage to the bride shall be maintained by the bride. (2)The list of presents which are given at the time of the marriage to the bridegroom shall be maintained by the bridegroom. (3)Every list of presents referred to in Sub-rule(1) or Sub-rule(2)- (a) shall be prepared at the time of the marriage or as soon as possible after the marriage; (b) shall be in writing; (c) shall contain:- (i) a brief description of each present; (ii) the approximate value of the present; (iii) the name of the person who has given the present; and (iv) where the person giving the present is related to the bride or bridegroom, a description of such relationship. (d) shall be signed by both the bride and the bridegroom"
पुलिस हर मुक़दमे में विवेचना के नाम पर मात्र उगाही ही करती है, ऐसे में 498a IPC के झूठे मुकदमों में फंसाए गए लोग भ्रष्ट पुलिस को विवेचना में सहयोग करने और न्यायालय के उपरोक्त आदेश का पालन करा हकीकत को उजागर करने उद्देश्य से आयकर विभाग में 'Tax Evasion Petition' फाइल करते हैं।
कानूनों व समाज में व्याप्त लैंगिक भेदभाव ने कारण हमारे देश में पतियों के आत्महत्या की दर पत्नियों के आत्महत्या की दर से ढ़ाई गुना ज्यादा है, और ऐसे में आपका यह एकतरफा और भ्रामक लेख केवल समाज को क्षति ही पहुँचा सकता है।
कृपया आप बताएंगे कि किस आधार पर आपने 'झूठे मुखबिर' कह कर 30 हजार की एक संख्या भी दे दी?
